If your child has an IEP and is in public school (mainstream class or Special Day Class) but one or more of the following situations exists:
- Your child is not showing meaningful progress in one or more deficit areas;
- Your child is in a classroom with many students that are not his or her age or function level;
- Your child has autism and is not progressing in his or her school program in key deficit areas;
- Your child is in a Special Day Class (SDC) and the school did not demonstrate your child could not be educated in a mainstream classroom with reasonable services and supplementary aids;
- The school calls you often to pick up your child due to behaviors;
- Your child is in a SDC with no evidence of results and no accountability;
- Your child was in a residential placement and the school demands they spend time in an alternative school before mainstreaming;
- The course code is not followed;
- Offered services are not effective for what is intended;
- Teachers change the assignments and/or grading standards for your child to make it look like they have mastered the material when they have not;
- A teacher does not allow alternative ways of showing mastery of content such as extended time on tests, quiet rooms, pause time and other accommodations;
- Your child is repeatedly enrolled in intensive reading/math classes in which little to no progress occurs;
- Your child was assigned to a class based entirely on his disability as opposed to his or her abilities;
- Unequal access to electives;
- Shortened school day for only your child;
- Failure to implement the IEP or 504 Plan;
- IEP meetings without qualified interpreters;
- School did not provide services for many days after start of school year;
- Your child is in a class where one teacher teaches multiple grade levels;
- Your child’s teacher is not credentialed or qualified;
- Your child was excluded from band or cheerleading or other activity because school would not provide reasonable accommodations;
- Your child is not allowed to attend field trips;
- Your child does well in school but is very anxious and misses school days due to anxiety; or
- Your child is unmotivated and getting failing grades in one or more classes.
